Terms of Service

Tradesian ("Service", "we", "us") is an online Software-as-a-Service (SaaS) platform providing a trading journal, performance analytics, backtesting replay tools, and AI-assisted educational content for retail traders. By accessing or using the Service you agree to be bound by these Terms.

1. Nature of the Service

Tradesian is strictly a Software-as-a-Service (SaaS) productivity tool for personal trade record-keeping, analytics, and education. It is billed as prepackaged computer software under MCC 5734 (Computer Software Stores) / MCC 7372 (Prepackaged Software). We:

• Do not execute, place, route, or manage any real-money trades on your behalf.
• Do not operate as a broker, dealer, exchange, custodian, or money transmitter.
• Do not hold, receive, or transfer client funds or securities.
• Do not provide trading signals, copy-trading, portfolio management, or guaranteed-profit services.
• Do not provide personalized investment, tax, legal, or financial advice.
• Do not operate a public social feed, public leaderboards, public chat, or any public user-generated content surface. Every dashboard, note, and analytics view is private to the account owner.

2. Not Financial Advice & Quantitative Educational Models

All content, statistics, backtests, AI outputs, playbooks, and educational material provided by the Service are for informational and educational purposes only. All quantitative metrics, options chain data, and mathematical projections (including QD Score, Expected Value, statistical probabilities, and Greeks) are computed strictly for academic, research, and quantitative educational purposes only. Nothing on Tradesian constitutes a recommendation, solicitation, endorsement, or offer to buy or sell any financial instrument, security, or options contract. Trading and investing carry a substantial risk of loss. You are solely responsible for your own trading decisions and outcomes. See our Risk Disclaimer for full details.

3. Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

4. Subscriptions & Billing

• Paid plans are billed on a recurring basis (monthly or yearly) as displayed at checkout.
• Your card statement will show the descriptor TRADESIAN* BLS (operated by Beyond Life Service Co., Ltd.) or a similar identifier.
• You may cancel at any time from your account settings; access continues until the end of the paid period.
• Refunds are governed by our Refund Policy.
• All prices are shown in the currency indicated at checkout and exclude applicable taxes unless stated.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose, fraud, market manipulation, or money laundering.
• Resell, redistribute, or expose the Service or its AI outputs as if they were investment advice.
• Attempt to reverse-engineer, scrape at scale, or overload the Service.
• Impersonate others or upload content that infringes third-party rights.

6. User Content

You retain ownership of the journals, notes, playbooks, and other content you upload. By publishing a Playbook publicly, you grant other users a limited licence to view and clone it within the Service.

7. Third-Party Services

Payments are processed by Stripe, Inc. Authentication, storage, and backend infrastructure are provided by trusted cloud vendors. Your use of these third-party components is subject to their respective terms.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that historical or simulated data (including replay/backtest) will reflect future market behaviour.

9. Limitation of Liability

To the maximum extent permitted by law, Tradesian and its owners shall not be liable for any trading losses, missed profits, indirect, incidental, or consequential damages arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you breach these Terms or use the Service in a way that creates legal, regulatory, or reputational risk. You may terminate at any time by deleting your account.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated in-app or by email. Continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles.
